General Terms of Order

The general terms of order apply to the legal relations arising from ordering goods (hereinafter - goods or products) presented on the website of T@C Company Limited OÜ (hereinafter - Teemaailm) at https://teemaailm.ee/ (hereinafter - the website), through the online ordering environment (hereinafter - the online store).

In addition to these general terms of order, the relations between the customer and T@C Company Limited OÜ are also governed by the legal norms in force in the Republic of Estonia, the procedure for processing personal data of T@C Company Limited OÜ clients (Privacy), the price list for Goods in the Online Store, and established good practices.

These general terms of order, the procedure for processing personal data of clients, and the price list for goods in the online store can be found on the Teemaailm.ee website.

  1. Order Procedure for Goods

1.1 To be able to order goods, the customer must register as a user of the Teemaailm.ee online environment.

1.2 The customer selects the appropriate product(s), specifies the quantity of each product, as well as the payment and delivery method. Before final confirmation of the order, the customer has the opportunity to review and modify the order. After review, the customer confirms the order. The order can be submitted in Estonian and Russian.

1.3 The delivery cost is added to the price of the ordered goods, according to the delivery method chosen by the customer.

1.4 The order confirmed by the Customer can be paid for using an internet bank link.

1.5 The order is considered received by Teemaailm after Teemaailm sends an order confirmation to the customer by email.

1.6 The order becomes effective after Teemaailm dispatches the goods to the customer.

  1. Delivery of Goods

2.1 Teemaailm delivers goods to the customer according to the method chosen by the customer when placing the order: to an Omniva parcel machine, or a SmartPOST parcel machine.

2.2 The customer chooses the delivery method when placing the order. The delivery cost is fixed in the price list, which the customer can review when placing the order.

2.3 Delivery time for goods:

2.3.1 Goods are delivered to the customer within the time specified in the online store (2-3 business days). The delivery time indicated in the online store is valid only for deliveries within the Republic of Estonia.

2.4 Methods of Goods Delivery

2.4.1 Omniva delivers the product(s) to the parcel machine chosen by the customer within Estonia as follows:

  • On the next business day if the order is placed before 14:00 on a business day
  • If ordered after 14:00, the order will be delivered to the Omniva parcel machine one business day later

Once the order arrives at the parcel machine, messages will be sent to the customer's mobile phone and email, indicating the parcel machine's address, operating hours, and a personal code to open the locker. Upon entering the code on the parcel machine's touchscreen (if necessary, after paying for the order by card), the parcel machine locker opens, and the customer receives the parcel. Parcels are stored in Omniva parcel machines free of charge for 7 calendar days from the moment the message is sent to the customer's mobile phone and email. After 7 days, Omniva returns the parcel to Teemaailm. Teemaailm will contact the customer again and arrange for the order fulfillment separately. If an agreement cannot be reached with the customer or if they cannot be contacted, the order will be cancelled, and the amount paid for the order will be refunded to the customer's bank account, minus postal services.

2.4.2 SmartPOST delivers the product(s) to the parcel machine chosen by the customer within Estonia as follows:

  • On the next business day if the order is placed before 14:00 on a business day
  • If ordered after 14:00, the order will be delivered to the parcel machine one business day later

Once the order arrives at the parcel machine, messages will be sent to the customer's mobile phone and email, indicating the parcel machine's address, operating hours, and a personal code to open the locker. Upon entering the code on the parcel machine's touchscreen (if necessary, after paying for the order by card), the parcel machine locker opens, and the customer receives the parcel. Parcels are stored in SmartPOST parcel machines free of charge for 7 calendar days from the moment the message is sent to the customer's mobile phone and/or email. For uncollected parcels, 2 reminder messages are additionally sent to the customer. If the customer does not collect the parcel within 7 calendar days, the order will be cancelled, and the amount paid for the order will be refunded to the customer's bank account, minus postal services.

  1. Consumer's Right to Withdraw from an Order

3.1 The customer-consumer (hereinafter - consumer) has the right to withdraw from the order of goods without giving any reason, from the moment the order is placed, within 14 calendar days after receiving the goods.

3.2 If the goods returned by the customer are used or damaged in a way other than what is necessary to ascertain the existence, properties, and functionality of the goods, Teemaailm has the right to claim compensation for damages in an amount that may reach the selling price of the goods, depending on the degree of depreciation of the goods. The specified amount will be deducted from the amount to be refunded to the customer.

3.3 To withdraw from an order, the consumer must submit a statement to Teemaailm by email at teepoodnarva@gmail.com.

3.4 In the written withdrawal from the order, the consumer must specify the bank account number to which the refundable amount should be transferred, as well as the name of the owner of such bank account.

3.5 If the consumer withdraws from the order, the consumer undertakes to return the unused and undamaged goods immediately, but no later than within 14 calendar days from the date of sending the withdrawal statement. The consumer can send the goods by mail to the address: Tallinna mnt 41, Narva. The consumer pays the costs associated with returning the goods.

3.6 Teemaailm refunds the consumer the amount paid for the goods, as well as the delivery fee. If the consumer returns part of the ordered goods, Teemaailm reimburses delivery costs proportionally to the quantity of ordered goods. Teemaailm refunds the money immediately, but no later than within 14 calendar days from the receipt of the withdrawal statement, but not earlier than after receiving the goods from the customer or receiving proof that the goods have been sent back.

  1. Registration Procedure

4.1 To become a regular Teemaailm customer, the customer must register as a user in the online environment at https://teemaailm.ee/.

4.2 After registering as a regular customer, the customer has the right to subsequently receive benefits intended for regular customers, in accordance with the Teemaailm regular customer program.

4.3 To register, all fields of the form must be filled in.

4.4 After registration, Teemaailm sends the customer a message with account activation instructions to the email address provided by them.

4.5 After account activation, the customer can log in to the Teemaailm online environment with their username and place an order for goods.

  1. Customer Rights

5.1 The customer has the right to order goods at the price and under the conditions specified in the Teemaailm online store.

5.2 The goods sent to the customer must be correct and complete, and must comply with the conditions established by Teemaailm.

5.3 The customer has the right to submit claims regarding the order of goods and the goods themselves to Teemaailm by email at teepoodnarva@gmail.com . The customer undertakes to notify Teemaailm of any non-conformity of the goods with the conditions immediately from the moment the customer became aware of such non-conformity. In case of defects in the goods, the goods will be replaced with similar ones, except when the corresponding goods are no longer sold. If the corresponding goods are no longer sold, at the customer's choice, the goods will be replaced with another, or the sales contract will be terminated, and the cost of the goods will be refunded to the customer.

5.4 The customer has the right to withdraw from the order of goods in accordance with clause 3.

5.5 In case of non-conformity of the goods with the terms of the contract, the customer has the right to use the remedies provided by law.

  1. Customer Obligations

6.1 When placing an order, the customer undertakes to provide the data necessary for order processing: first and last name, exact address (street, house number, apartment number, postal code, city/settlement or village/county), contact phone number, and email address.

6.2 If the customer and the recipient of the goods are different persons, the customer must provide the data specified in clause 6.1.

6.3 If the data provided by the customer is incorrect and/or incomplete, and does not comply with what is specified in clause 6.1, Teemaailm does not guarantee timely delivery. Teemaailm will try to contact the customer to clarify incorrect or incomplete data.

6.4 By placing an order, the customer confirms that they agree with these General Terms of Order and undertakes to comply with them.

  1. Teemaailm Rights

7.1 Teemaailm has the right to amend these General Terms of Order for goods without prior notice by publishing the new valid terms in the online environment.

7.2 Teemaailm has the right to change the online store's price list at any time without prior notice by publishing the new price list in the online environment.

7.3 Teemaailm does not guarantee that the manufacturer's description of the product corresponds to the customer's opinion of the product.

7.4 If the customer fails to fulfill the obligations imposed on them by these terms of order, Teemaailm does not guarantee the processing of the order and/or timely delivery of the goods.

  1. Teemaailm Obligations

8.1 Teemaailm undertakes to deliver the goods to the customer in a correct and complete form.

8.2 Teemaailm undertakes to accept and document all customer claims.

8.3 Teemaailm undertakes to review customer claims within 7 business days, provided the reasons for the claim are not caused by the customer. If the reason for the claim is caused by the customer, the customer undertakes to eliminate such reasons.

8.4 Teemaailm undertakes to exchange defective items of goods. Teemaailm is only responsible for manufacturing defects and other damages that occurred during the transfer of goods to the customer.

8.5. All disputes between the parties shall be settled through negotiations. If an agreement cannot be reached, and the customer insists on the complaint being reviewed, the customer has the right to:

8.5.1 contact the Consumer Disputes Committee at the Consumer Protection Department at Pronksi 12, Tallinn 10117 or by email at info@tarbijakaitseamet.ee.

8.5.2 apply to court.
